Yesterday England’s Supreme Court in London struck down two Holyrood Bill’s.
MSPs had unanimously backed the bills – which enshrine treaties on children’s rights and local government in Scots law – prior to May’s Holyrood election.
However after a challenge from English/UK law, officers, judges said the legislation could affect Westminster’s ability to make laws for Scotland. That should set off alarm bells in us all, England’s ability to make laws for Scotland!
Neither of these, Bill’s were in the least controversial, indeed even the Tories found themselves able to support both. Their indignation and opposition only appeared after their English bosses took this action.
The implications though are far worse than just these two Bills. I am certain the Scottish Government will amend these laws, and the English imperialists will ‘graciously’ then allow them to pass.
This was, England/Westminster putting down a marker to put the Jocks back in their place. We are in charge. You cannot do anything without our permission. You Scots are our bitches. Do not even think about trying to pass a Referendum Bill. Our courts in London will just strike it down.
Now, of course, this should be the time for Nicola Sturgeon to deploy her famous secret plan. The plan we have been told by the faithful that she has had ready since 2015.The only problem is as those of us, with half a brain know, she has no Plan. She prevented Angus Brendan and Chris McEleny from presenting a debate at the annual conference for four years on the trot. The last year minus Chris. She has not had a single discussion on Independence at the NEC since she took over in 2014. She has not come up with definitive policies for Currency, Borders, Defence, secession. She has done zero preparatory work to move Scotland out of the Union.
In the disastrous 2017 UK General Election word went out to all the branches, fighting the campaign, do not use the Independence word on any material or at any doorstep or in any street conversations. The outcome we know was the SNP lost 21 MPs. The Tories, gained most of all, and their confidence grew that they could actually stop the independence juggernaut. Our timidity gave the Unionists hope!
Today Sturgeon’s Gold Standard Referendum Section 30 plan lies in tatters and she has no clue, idea or desire what to do next. The insipid response by John Swinney sums up the lack of backbone or fight in this SNP Government.
It also highlights Scotland’s place in this so called Union of Equals. While technically Scotland is a joint signatory to the Treaty of Union the practical reality is different. We are in everything but name a colony of Greater England.
Oliver Dowden MP, a Conservative Co Chairman expressed how most English and all Tories view Scotland. While berating the First Minister and her domestic record, he said this, ‘I think we have a real opportunity to focus on the actual delivery of the nationalists in Scotland, which has been completely lamentable – whether it’s education, whether it’s health, they are falling massively behind the rest of England.’ The rest of England!!
Michael Goves pronouncement that Westminster would not allow the union to break. Sir Keir Starmer saying similar, our English neighbours view Scotland as a possession, not an equal partner in a union. The very fact that we allegedly need Westminster’s permission to do anything shows it is not a Scottish Government at Holyrood, it is an English Colonial Administration.
You might rightly ask how this came about. It is a fair question my explanation is equally simple. We the Scottish people allowed it to happen. In 1707 as the ordinary disenfranchised Scots rioted throughout Scotland over the Treaty of Union the Lords that had sold us out to cover their Darien debts complied to the will of England. They decided to keep their heads down and their mouths shut rather than demand and apply the rights of the Sovereign people of Scotland. Like today they put themselves before the needs of the nation. Till the time of suffrage the Scottish Earls and Lords sitting at Westminster allowed the majority English to bully and cow them. After the 1745 Rebellion the Scots at Westminster wanted to show their devotion to the Germanic monarch and their rejection of the accursed Jacobites, the independinistas of the day. They sat silent as Scotland was garrisoned and its people murdered and ethnically cleansed. These same Earls and Lords grew wealthy on Scots, suffering. Sheep were more of a profit than their Scottish kith and kin.
Then as suffrage came in the elected representatives we sent were quickly subsumed into the Imperial ways of Mother England and Westminster. A life far greater than was possible in Scotland was there for the taking provided you complied with the rules of the English establishment. Sinecures throughout the empire beckoned for those that bent the knee and knew their place on the totem pole. Sticking up for Scotland was not a good career move.
We had hoped when we sent 56 out of 59 SNP MPs in 2015 we were sending 56 Winnie Ewings who went down to settle up, not to settle down. Sadly, that did not turn out to be the case. We now, six years later have mainly 40 odd Uriah Heaps, not 40 Winnie Ewings. There are notable exceptions like the two Alba MPs, Joanna Cherry, Angus Brendan. Sadly the rest have been seduced by London life. In all the time since 2015, when we wiped the floor with Unionists, we have achieved nothing!
The reality is simply this even if all 59 Scottish MPs were Independence supporters we can achieve nothing. Greater London has more MPs than all of Scotland. We are defeated on every vote. We have had not a single SNP sponsored Motion or Bill that has won through the Westminster system,with one exception The Claim of Right! The time is here for us to use that claim.
During the Scotland Bill stages over 100 SNP Amendments were defeated by the single House Jock Tory, Mundell and spineless Red Tory Murray who joined forces with the English majority to do down their own nation of birth.
We have been dragged out of the European Union against our will. We have been forbidden from holding an Independence referendum. Our pleas over the £20 Universal Credit cut ignored. Every plea over every instance at Westminster has been ignored and rejected. Why do we continue to humiliate ourselves and our nation by allowing the English Parliament to treat us like a piece of shit on their shoe?
I have long advocated that we should not be in that corrupt anti-Scottish, anti- democratic building. Our MPs should withdraw today and never return. As I have stated many times, we need to call a Grand Assembly and withdraw from the Treaty of Union. We do no good for our nation sitting there every day.

Scotland’s problem is not that England have X number of MPs, a greater population share or that votes are pointless within the parliament of GB. As legally equal partners to the treaty those are irrelevant. It is that Scotland has a government that abdicates responsibility for the governance of Scotland and hands the reins over to England. The English court verdict is a direct result of that abdication. If the Scottish government truly wanted to dissolve the treaty but were unsure how to go about it they could have suspended the treaty and then decided. They have chosen not to do so. They have chosen instead to not only agree with the English court judgement but to subjugate Scotland and violate Scots sovereignty.
As said numerous times, the buck stops here in Scotland. It is not the duty of a foreign country’s government to tell the Scots how to assert their authority nor uphold their rights. It is the duty of the Scots. If the Scots fail to assert their authority they cannot blame others for asserting their authority over them.

The pursuit via a Referendum is now pointless as the dice will be loaded regarding thresholds, who can vote, the question, the confirmation ballot etc, etc, It came too close last time and they will never risk a fair open democratic vote again.

We have 31Tories at Holyrood because Sturgeon demanded “both votes SNP” clear evidence that her ego is greater than any consideration of Independence for Scotland.
Sadly I will not face the dilemma of voting YES in a Sturgeon led Independence Campaign for the simple reason that she will never allow one.

The problems with these bills were deliberately created by the SNP in order to stage manage a grievance in the run up to the last election. The bills were deliberately worded to exceed Holyroods powers, ensuring that they would fail when challenged.
The bills got unanimous support in Holyrood because any opposition MSP who voted against them would have been accused of attacking childrens rights.
The UK governments decision to take the bills to the supreme court was used to attack them during the election, and of course it helped Sturgeon with her ‘both votes SNP’ campaign.
The simple fact that the UK signed up to everything in these bills 30 years ago was ignored by the SNP spin doctors and the party faithful.
This isn’t UK government overreach or evidence of ‘colonialism’ is is just sleazy manipulative political posturing by the SNP – the party that has presided over ever increasing child poverty and done nothing.

Not going to pretend i know if this was clever strategy to expose colonialism or just plain incompetence.
Spot on with this article, there’s only two ways out of this union now, and none of them are Sturgeon’s Gold Standard, which is nonsenses to begin with.
One, use the 2026 Scottish elections as a plebiscitary election.
Two, call back our MPs from Westminster and hold a vote at Holyrood and if yes wins declare independence there and then.
The only thing stopping any of these two routes to independence is Sturgeon, she’s not interested in, or is too gutless and incompetent to carry out option two, (my preferred route out of this rancid union) just now, after Westminster slapped her, and Scotland down with a foreign Supreme courts ruling.
Barring a scandal that’s Sturgeon cannot recover from and her resigning as FM, and a brave courageous indy minded FM put in place, who’ll implement option two, I see no way out of this union until 2026, and even then under this SNP’s leadership I don’t see the SNP government pre-election (2026) campaigning on using it as a plebiscitary election. Pre the 2021 Scottish elections the SNP slapped down the idea of it being held as a plebiscitary one, even though many folk wanted it to be one, as they seen what was on the horizon.
No option two is in reality the only way out of this union, but how do we get to the stage of implementing it, when we cannot get someone into Bute House who’ll carry it out.
Why not the 2024 UK General Election. Why wait till 2026?

Nationalist MPs, and now three successive Scotland Nationalist majorities at Westminster, and also elected three Nationalist majorities in colonial admin Holyrood too, and still they all sit there quietly, like rabbits in headlights.
Self-determination independence is about sovereignty AND removing an oppressor as much or even more than it may also be a matter of democracy – which rev Stu thinks. I’m quit interested to understand the dynamic of Scots nationalism. Most of my friends and I are Scots nationalists from the East coast.
We tend to be of Irish Catholic roots but dont perceive ourselves to be Irish and or Catholic so thats of limited influence but I’m intrigued by the uniformity of ideology.

Postcolonial theory tells us that the colonizer views the culture and language of the colonized to be inferior, hence will not embrace it, and will rather tend to diminish and remove it via cultural assimilation processes; this explains why the Scots language is never taught in Scotland’s schools nor given statutory authority, and why Gaelic was all but destroyed (linguicide). Colonialism is also about changing a peoples national identity, which is formed by their culture and language, i.e. via Cultural and Linguistic Imperialism. By taking away a peoples language (mither tung) you take away their identity, or their desire to hold to that identity.
The basis of colonialism and resultant ‘colonial mindset’ psychological conditioning (of the colonized) is therefore brought about and reinforced through cultural oppression and in the portrayal and stereotyping of a superior and an inferior culture, resulting in a Cultural Division of Labour favouring the dominant culture, and marginalising the ‘subordinate’ culture, which gives rise to the inequalities and exploitation we see today, as well as historically. This also results in an underdeveloped people and nation.
Which reflects Fanon’s finding that independence and hence decolonization is also about a people reclaiming their ‘moribund culture and rusted tongue’, and casting out the imposed oppressive culture… and its language.

I agree with you, Roddy. We must stop playing their game. But we have made headway since the seventies when I used to sing that famous Burns song at concerts – I was convinced few knew what the song was about. However, I think most would have an idea now-a-days!
No wonder the Scots were cowed after the ’45. The Butcher with his Butcher’s Apron made sure of that. It’s one area in which his compatriots are exceptional, regardless of the country they decide to subjugate.

The British establishment was shocked to its foundations in 2014/16 and will now do absolutely anything to hang on to Scotland and her resources. Apart from its highly accomplished money-laundering service in the City of London, that same British Establishment has very little of lasting value to show for its centuries of worldwide colonial plundering. Scotland remains as the very last jewel in the imperialist crown and the colonisers can be expected to use every available means to hang on to it. The bulk of the independence movement’s work ought now to be concentrated on pointing-up what the actual relation has become between Scotland and England since 1707 i.e. that of Colonizer and Colonized.

What we see in the outcome of these legal cases here is arguably the western Imperial Powers narrow self-interest interpretation of what is defined as ‘internal self-determination’, which has inherent limitations for any oppressed ‘people’.
And as Albert Memmi tells us, and the UN Declaration implies, the inalienable right to external self-determination (i.e. independence) of a colonized people ‘has nothing to do with the colonizer’.
Alf: you know, I have been looking at comparisons and similarities between colonization of Scotland and colonization of women, and they are virtually identical: close down debate and shout “anti English” at any demur at the establishment position; take control of the language and the culture of the colonized (or to be colonized); and the fawning collaboration of many of the colonized group. Sorry, I’m not trying to drag up the trans issue again into this issue, which I also feel very strongly about, but the similarities are astounding, suggesting that colonizers use exactly the same methods wherever and however they colonize, and that the colonized, or about-be-colonized make a fightback almost at the point of eclipse after having been co-opted, many of them, into the colonizers’ camp through various strategies and tricks and sleight of hand. The end result is also always the same: the colonized are systematically made poor and eliminated from the well-paid jobs, made to do the dirty and hard work and pushed to the point of extinction from all public existence until they rise up and throw off the yoke, if they ever manage to do that. It is uncanny and very frightening that it is precisely the same strategy for a country, a race of people, a group or individuals – relentless take-over.
The people of Scotland are sovereign in Scotland.
Westminster must be bypassed and ignored.
Scotland must withdraw all pro-independence politicians from Westminster.
A vote must be taken in Holyrood to end the union with England.
If the vote is passed Scotland must declare to the rest of the world that Scotland’s independence has been restored.

Maybe it’ll take only a few in the party, like Angus Brendan, Joanna and a couple of others coming to the realization that there is absolutely no future for the cause, in this party of Sturgeon worshippers, ditherers, and subservient House Jocks, and coming over to Alba, which could possibly start an avalanche of other MSP’s/MP’s.

I would hope they would however I think it is highly unlikely Johnson will call an election before Dec 2024 why would he, he has an 80 seat majority? He has nothing to gain and everything to lose by going early.

This is very revealing, why go outside Scotland for analysis, the only reason I can see is that to do so, helped push the percentage who agree with the GRA up. The SNP government must’ve been afraid to keep the whole thing in Scotland the way it should’ve been, because it would’ve reflected badly on their very unpopular GRA agenda.
Roddy, we all know that in 1707when the traitorous parcel o rogues betrayed us the Scottish people up and down the land rioted for months. The people would have rightfully and justifiably killed them if they could have gotten their hands on them, remember that they did the dirty deed in hiding.
Now I’m not saying that the present mps and msps should be killed, not at all.
But they must be made fear the people every one of them. They should all receive sack loads of communications every day warning them of the consiquences of their lack of action cowardice and treachery. We need to focus their minds back on the cause.

Watched a programme some years ago, where a dog was offered a treat which was then removed from his reach. This happened three times, then the dog refused to even acknowledge the treat and left it lying on the floor. When the behaviourist turned round to the camera, the dog nipped in and grabbed the treat, and, when the behaviourist tried to take it from him the dog nipped him and bared his teeth. A excellent two-page article by Joanna Cherry in the National today regarding constitutional matters, who’d have thought that the Good Friday Agreement allows Northern Ireland to hold a reunification referendum EVERY seven years, with a 50%+1 result to make it official .
Yet we have the likes of Gove, Johnson and the Scottish Secretary of State, Alister Jack, (the latter chastised by Professor Tom Devine for not knowing that the border between Scotland and England actually has a function) repeatedly state that Scotland cannot hold another independence referendum for at least twenty-five years, and that a 60% winning margin is required.
It is also very interesting to note that the UK Supreme Court is not an English court its a UK construct, with the current president and deputy president positions held by two Scottish judges.

Republic: Westminster wants shot of NI, always did since 1921, so no surprise there. It was offered as an inducement to De Valera in 1939/40 to enter WW II on Britain’s side instead of opting to remain neutral. De Valera, turned Churchill down unequivocally, knowing full well what joining Britain would mean for Irish independence in the future, and what the burden of NI, by that time, a hostile statelet to the north and wedded to a Britishness that had already gone in the UK, would mean for Irish unity in the south.
The Supreme Court came into being to rule on EU Laws and to continue the constitutional rulings of the HoL. Since the constitutional ruling of the HoL was already illegal according to the Treaty of Union and the opportunity was there to pass back to the Court of Session its previous, pre 1707 rights, also enshrined in the Treaty, it was an imposition of such arrogance and ignorance on the Scots that it hardly bears scrutiny without blowing a gasket. It was pure English colonialism – not British at all – and, as a continuation of the powers of the HoL, populated like the Commons, by English Lords/Ladies and Churchmen, in such numbers that the Scots, NI and Welsh all together can’t make a dent. This is not democracy, but rule by England under the guise of the UK. That no devolved administration in Scotland has ever made submissions to both Westminster and the UN on the impossibility of effecting any change to our situation that does not chime with England’s – and it is England’s – wants and needs first and foremost is an utter and absolute disgrace. The SNPG should hide away in shame because it is just plain fact and the truth, not any kind of anti Englishness. I would be just as appalled and angry if England was under our thumb like this because of the in-built and inherent lack of democracy. It is colonialism that disguises itself like a Hallowe’en figure crying trick or treat (a la American version) and it’s always a trick.

Thank you for that interesting comment, I have to add that Cherry also said that, the denying of the SNPs UN Child Rights bill by the UKSC, was on a very keen a strict reading of the law, and its more than possible that this “keen and strict reading” of the laws surrounding devolved matter would be translated on any challenge against Scotland having the right to hold its own indyref without Westminster’s input, so yes British often translates to English in my book.
I would prefer we held an indyref if we have to (my main route would be to declare independence at Holyrood via a MSP/MP vote) without any Westminster input, even sooner, would be the next GE using it as a plebiscitary vote to leave this odious union.

Ditto, Republic. I think that the referendum route (apart from a ratifying referendum for the sake of democratic accountability after independence) is now a non-starter. I have never supported one, not even the first. Every ounce of evidence suggests we would lose again. As well as declaring independence in the wake of a GE win, I’d want the Treaty to be ruled on at the UN while we wait. We need six months or so to accumulate the evidence to support our case, but I believe that it would be unassailable. I also believe that the English ruling elite knows it, too.
