NEALE HANVEY MP CALLS FOR INFORMATION COMMISSIONER TO INTERVENE IN SCHOOLS SURVEY FIASCO

 

AS “NANNY NICOLA” IGNORES LEGITIMATE PUBLIC CONCERNS

 

ALBA Party Westminster Leader Neale Hanvey MP has written to the Information Commissioner calling on them to intervene in the row over the Scottish Government’s Health and Wellbeing Survey in Scottish schools. With a growing number of councils already placing it on hold and The Children and Young People’s Commissioner calling for the Scottish Government to pause the survey so as to address concerns about human rights compliance, Mr Hanvey is taking this further step to ensure that the concerns of parents and teachers are fully considered and addressed.

In a statement Neale Hanvey MP said:

” Given the serious concerns which exist among parents, teachers, a growing number of councils, The Children and Young People’s Commissioner and the wider public I have written to the Information Commissioner’s Office (ICO) asking them to intervene

“ As part of the Health and Wellbeing Survey which is in the process of being rolled out data will be collected by the local  authority and potentially shared with the Scottish Government and unspecified third parties.  The data subjects are mainly children (under 18) and the child is identifiable by their unique Scottish Candidate Number and survey answers can be traced back to each child.

“ I have therefore asked the Information Commissioner to look at whether Article 16 of the United Nations Convention on the Rights of the Child (UNCRC), which provides children and young people with an equitable right to privacy, may have been breached, as well as the family’s right to privacy under the UN’s Universal Declaration of Human Rights.  In addition I  have also raised the issue of informed consent for child participation in the survey as this would seem an absolute pre-requisite.

“The Scottish Government further state in their privacy notice that data may be linked with other data they hold for an individual child.  This goes beyond and contradicts the intention of anonymised data collection for purely statistical purposes and analysis so I have sought the Information Commissioner’s views on this important matter.

“ The First Minister’s insistence that parents or the child have the right to opt out does not give the reassurance in practice that is required and fails to take account of the fact that GDPR consent requires a positive, specific and granular response for each processing purpose e.g. general wellbeing, mental wellbeing, use of alcohol, use of tobacco, use of drugs and relationships and sexual activity/health.

“ It is time that the First Minister recognised the legitimate concerns of parents and teachers that this survey goes way beyond the gathering of data for statistical purposes but represents a potential intrusion by the state into the lives of children and young people which potentially threatens both their privacy and human rights.   Her failure to recognise these concerns will result in her earning the epithet of ‘Nanny Nicola’.”

Mr Hanvey has asked the Information Commissioner a series of detailed questions in a number of key specific areas.  In his letter he states:

“Once a child has participated in the survey the Scottish Government state that they will have surrendered any right of access or control over their data, including asking for their data to be deleted.  I hope you will agree this is irregular and should concern any guardian?  What privilege is the government obtaining by this broad limitation of any semblance to privacy? What future use may the data be utilised for and does this mean that the state is using its apparatus to potentially criminalise its citizens

“Which exemption the Scottish Government are relying on to deny the child and their parents/carers these fundamental rights

“Do you believe that informed consent (including full access to the census questions) should be sought from parents/carers/young people prior to the child’s participation

“Do you believe that the threshold for consent, data sharing/retention and GDPR rights are being complied with in the supporting FAQs and Privacy statement

“Do you believe the conduct of this survey is compatible with both Article 16  of the UNCRC, and the right to privacy as laid out in the UN’s Universal Declaration of Human Rights

“Do you believe this survey is compliant with GDPR legislation? Can you please detail any specific points to illustrate your assessment?”

  • With each intervention, I find myself increasingly impressed by Neale. Serious and measured, we and Alba are fortunate to have him on our side.

  • Completely agree that Sturgeon and her chosen ones should be held to account . It’s incredible that they thought they’d get away with such abominable behaviour. Thank you, Neale Hanvey. I’m sure the majority of parents and grandparents in Scotland will consider themselves indebted to you.

  • I seem to recall that this questionnaire references the previous year in which case it could mean children answering questions regarding when they were only 13 years old and possibly mistakenly when they were 12. This is in every way unacceptable and looks to me as though this is subliminaly suggestive of normalising unnatural sex in kids

  • Sturgeon when asked about the obscene questions posed to children in her Health and Wellbeing Census 2021 said, She stands by the survey, and not to put concerns on parents for completely unnecessary reasons.

    Sturgeon’s defence of the lewd questions includes that the survey isn’t mandatory, even though 24 of Scotland’s 32 local authorities have said that they’ll take part in the survey.

    Do the parents of the children, who those disgraceful lewd questions are aimed at know that their local councils are taking part in the survey, I bet most of the parents are completely unaware of what’s going on.

  • The FACT that Neale Hanvey is having to highlight this PERVERTS CHARTER by a shower of deviants illustrates and massively highlights just how USELESS and COWARDLY the current crop of SNP MP’S and MSP’S are , NOT ONE of them is standing up to sturgeon and her tartan taliban troops to PROTECT and SAVE our children from this lunacy , do none of them have children or grand children that they LOVE and cherish , are they HAPPY for their children and grand children to participate in this perverts charter , are they HAPPY for those innocents to be subjected to probing personal intimate questions in the guise of caring , are they HAPPY for that extremely private personal information to be readily available to be SHARED to other organisations who will HANDLE it in whatever way they see fit . Despite all the assurances of privacy regarding the security of information , we have REPEATEDLY WITNESSED the FAILURES of these assurances , with personal sensitive documentation being found in bins , left on subways , left on trains , left in coffee houses , by an assortment of these guardians , and we are supposed to trust the CLOWNS in HR to safeguard children’s sexual information , when we have the same clowns who can’t find texts , whatsapp messages , or documentation or diaries to prove that meetings took place , or a FM appearing at an enquiry who can’t remember or doesn’t recall or doesn’t have that information to hand in an answer to over 50 responses to questions , US TRUST THEM

  • Thank goodness that the concerns of parents and teachers are being fully considered and addressed in vitally important areas… something which cannot be said about the Scottish Government state, today! Furthermore, we’ve unwittingly fallen into the process of elevating favoured politicians to a hero/star-like status!? After all, an elected politician is there to SERVE the electorate!

    Politics were seldom easy to follow or understand! Yet I’ve been devoted to Scottish politics since my teenage years – now a retired person, but kept busy: Arts & Crafts in our workshop, with plenty to do! Otherwise, how’s our parliament being seen by our youngsters, perhaps thinking about their future prospects also? Hopefully, this uncertain political phase might inspire and/or alert some of our less involved politicians? Well, here’s hoping!

  • Heartfelt thanks for this, Neal, which will be greatly appreciated by everyone opposed to this latest SNP “ state snooper “ scheme. Their flawed Named Person scheme was ditched after a Supreme Court Ruling that it breached rights to privacy and family life under the European Court of Human Rights. “Information-sharing makes it perfectly possible that confidential information about a young person could be disclosed to a “ wide range of public authorities without either the child or young person or their parents being aware”.

    Not only is this school survey deeply intrusive, deeply personal and just plain wrong on so many levels, it seems to be in breach of international law. Shirley Anne Somerville should hang her head in shame. But she has a track record of being promoted whenever she f***s up, which is most of the time.

    To the 64 SNP MSPs: Am I right in thinking you all agree with this? You’re ok with this? At a time when young people are struggling with their mental health as well as the emotional and physical turmoil of adolescence, we should be helping to educate, inform and provide learning opportunities for them to share their own experiences and fears and anxieties about personal relationships. To help them navigate the minefield of consent and prevailing cultural norms and attitudes and in a safe environment. The most common victim of child sexual assault is a teenage girl, her assailant a teenage boy.

    To the 64 SNP MSPs: Your silence is deafening and gives legitimacy to the deviant, fetishistic and downright dangerous ideology at the dark heart of your party. Break cover, take a stand and have the courage to show your true opinion. Alarm bells are ringing all over the court of public opinion. Stop this NOW.

  • Surely its time for Sturgeon to go. Independence has been mismanaged, she is a barrier to a united movement going forward. The victimisation and vilification of those who disagree with her,she is a destroyer not a unifier. Interestingly we would be free if it was not for her section 30, nonsense. Why does she insist on this .No other country has went down that route to independence and gained independence. All you need is a simple majority, we have that in Westminster and Hollyrood. Withdraw our MPs from Westminster and disolve the union. The voting franchise is also rigged and needs to be urgently addressed.
    The voting franchise should only be for the indigenous population on constitutional matters this recognised by the UN and international community. No country opens up its voting franchise to to foreign settlers. Even the Westminster government stopped EU citizens voting on Brexit. EVIL English votes for English laws. This was only stop last July so Westminster could clam that it was racist not giving the English settlers the vote undemocratic. ( Its daftys that buy it) Every other country that has left the Empire realised this .Those who try and sell the current voting franchise are Unionists that includes Sturgeons SNP.
    The local voting franchise is a reset button for the union, it is rigged ,this is the safety net for the union if it comes to a referendum. You think you have lost the vote and cant understand why. Wake up brothers an sisters 1 million settlers are now resident here in Scotland, there mother country is England their allegiance is to England their vote is for the union. We all know English friends and family that will vote for independence it is nieve to think 1 million will. Once we have a Yes vote on a proper UN Decolonialisation franchise all the settlers can be offered citizenship in our new country. Its safer just to take the next election and disolve the union.

      Oh you’ve got privacy concerns. These are not the same privacy concerns that you don’t have about asking our children. There the state has the right to ask and log the results.

      Or what of Peter anecdotally reported to enjoy male on male relationships. Is he a giver or a taker. We need to know.

  • I have campaigned for Scottish Independence for a long time. I did not care if a fellow activist on a YES Stall was SSP, Tory or of no political persuasion. The target was the Right to Self Determination by the People of Scotland.

    If the majority backed that, then the majority of the Nation could address ANY concern from WMD, NATO, EU membership, Child Poverty, Republic status etc etc
    I thought “We the People would decide! I thought that we would have a Forum of the People that the Government would listen to. A People’s Assembly. I thought we would have Referendums on major social issues as they do in Ireland.

    Alas it was not to be. The ruling class of Westminster is to be replaced by a ruling class under Sturgeon. She will decide NOT the People.

    Women’s Rights will be removed. Children will be used in social experiments. The Law will be used to enforce Sturgeon’s dictates.

    What am I voting for now if I vote YES in a mythical Referendum?
    Do I want my granddaughters living in Sturgeons vision of Government?

    I thought we would all have an input into OUR future but it appears that only the elite “Party Members” selected by “Mammy” will shape Scotland.

  • The difference is we can vote Sturgeon out and get another independence party in. Sturgeons time is coming to an end. Westminsters rule is totally corrupt the British state turns our politicians , the colonial game ,even more need to get away from this rotten to the core state.
    The Brits game is to make you think what’s the point in independence if it all going to be the Same. Wrong the people will choose and reject those who do not work in our interests. This fears them.
