A New Union.

It is a well known fact that anyone with an addiction has to first admit to themselves that fact before recovery can begin. The same can be said on major problems and situations in our life. A failing marriage, a failing business. Only once you realise you have a major problem, can you clear your mind to commence recovery.

The same can be applied to anything including political parties or our entire political structure. The political institutions in every part of the UK are failing the people, that is undeniable. In Westminster we have a virtual crime syndicate sitting in government. Corruption, outright criminality, total disregard for law, nepotism, an unelected head of State and an unelected second chamber with 784 party toadies, donors and lobbydossers. 92 of those are hereditary peers. Some of them because a distant ancestor happened to be involved in the Norman invasion of England in 1066!! The UK is a feudal system of government. It needs to go!

The UK Union along with Israel and New Zealand are the only three so-called democracies in the world that do not have a codified written Constitution. Even the ‘bad guys,’ Russia and China have written constitutions. In Russia they elect their head of state so President Putin has to get the votes of the people to remain in office. In China The National People’s Congress nominate the President and do so every 5 years. We are told these, are not real democracies. How did you vote last time you were asked about Queen Elizabeth as Head of State? How many of you voted for Lord George Foulkes?

In the UK we have a head of state for life that never has to even be approved by a National anything, it is a given. Charles will succeed Elizabeth and in turn William then George will become heads of the ‘State.’  In the 21st century it is an archaic and ridiculous situation. The sooner a Republic is declared the better!

What most subjects in the Union do not grasp is that all power comes from the crown. The Parliament in Westminster takes that ‘sovereignty’ from the Germanic Saxe-Gotha Coburgs née Windsor and uses it to rule in a dictatorial manner. We only think we have a democracy because every five years or so they allow us to visit a polling station. Did you know that on average only around 5% of seats ever change hands?

With no written Constitution we are in the dark to what rights exist or actually mean. With this unwritten version those on the gravy train get to tell us what they deem to be our rights. The law of the land in all parts of the Union is to protect the rights, and property of the haves, not to defend the rights of the have nots. The price of justice in the UK is beyond the pocket of 99% of the average Joe and Jennies! The recent revelations about Geoffrey Cox the former Attorney General of England receiving £970,000 for 705 hours work epitomises the greed and cost of justice in UK. That is the equivalent of £1,375.00 per hour. Contrast that to the poorest in our society. The National Minimum Wage will range from £4.30 to £8.36 per hour, depending on age and if the person employed is an apprentice. What chance does anyone in that pay bracket have of employing legal services of a Geoffrey Cox?

In present day UK we do not have a real democracy or a real legal system. Both are set out  in such a way to serve the 1% and keep the 99% in subdued obedience.

Be assured though this 1% are not some group of gormless Etonian types like Johnson and his ilk. They allow people like Johnson to think they are in charge. They are the puppets and the puppeteers are people whose names you will never know.

The City of London Corporation have a unique and unquantified grip on our ‘democracy.’ In the House of Commons a figure called The Remembrancer: an official lobbyist sits behind the Speaker’s chair and ensures that, whatever our elected representatives might think, the City’s rights and privileges are protected. Indeed, good Queen Betty has restrictions put upon her. She may be the sovereign of the United Kingdom, however, Her Majesty the Queen is not allowed to enter the City of London without the permission of its Lord Mayor, Vincent Keaveny. That is why the ‘elected mayor’ of London Sadiq Khan is known as Mayor of London, note the subtle difference. How many Londoners even know this, let alone the rest of the Union public? It again gives the appearance that the public exercises some control over their destiny, they do not. The 1% are very much in charge. Sadiq with millions of votes at his back cannot sit in the Westminster chamber, unlike the vote less Rembancer. Does that sound like democracy to you?

Owen Patterson an MP for Shropshire was found to have been taking what can only be described as bribes. After a furore and a failed attempt to prevent any disciplinary action against him he merely resigned his seat. Punishment enough his MP colleagues brayed! That ensured his corruption went unpunished. There is even talk that Johnson may give Patterson a peerage!! Nice to be in the establishment, eh? He should be locked up as a common criminal for fraud!

He had been getting paid £112,000 pa over and above his MPs salary of £82,000 to represent the interests of companies called Randox and Lynn’s Country Foods. However greed motivates these people not public service or eradicating poverty, he put these companies needs ahead of his constituents!

Documents revealed he had several meetings with officials and another with a minister. He also wrote asking them to take steps that would benefit the food manufacturer Lynn’s Country Foods and the healthcare firm Randox. When caught his punishment was to be a 30-day suspension from the House of Commons.

On 9 June, Gove was found to have broken the law by awarding a £560,000 contract to a communications company called Public First, which is run by associates of himself and Dominic Cummings a decision tainted by “apparent bias and was unlawful”, according to the English High Court decision.I think I have heard that phrase before and just like this case no action was taken against the perpetrators.

In February, Matt Hancock the then Health Minister was found by a High Court judge to have acted unlawfully by failing to publish multibillion-pound Covid-19 contracts within the legal 30-day period.

We also know that £37 Billion was spent on a Track and Trace system that has never been accounted for, nor is it ever likely to be mentioned again.Nor will anyone ever be brought to account.

This is as big a mystery as the expenditure on HS2 all to take 30 minutes off of a Birmingham to London train journey. The current estimated cost of completing High-Speed 2 is between. £72-98 billion (2019 prices) This equates to approximately £307 million pounds for every mile of track. In France the cost of their high-speed rail links is £7.45 million per mile!! Only £300 million a mile cheaper. Maybe Westminster should have asked France to build HS2! You can be assured someone is making a lot of money out of this latest UK infrastructure build. Ultimately the banks of Panama or the Cayman islands will see a greater benefit of this money than the citizens of the UK. The smell of corruption is overpowering.

The biggest disgrace in all of the above is that nobody ever faces criminal charges in any of this blatant illegality and corruption. However if a UK citizen fiddles a few hundred quid of housing benefit they are likely to end up in prison. Tax evasion and avoidance meanwhile are not even regarded as unacceptable in UK.

That is why the entire structures of power in UK need ripped apart and rebuilt. We need a written Constitution. A fair voting system with recall inbuilt. An elected Head of State and second revising chamber. The end to the ancient practices like Monarch having any say or influence whatsoever in any aspect of our governance. The state grant should only apply to the monarch.The rest of her family to fend for themselves and unlike her pay taxes, not decide what they pay!

One residence only supported by the state. The other palaces and residences either need paid out of the monarchs own pocket or taken over by the state as tourist attractions. The Crown estates should be disbanded and the revenues given to governments of these islands, not a central pot. A new Treaty of Union where those that wish to remain in any new union have an equal say. No more of this English inbalance.

Prior to any new agreement, there should be referendums in Scotland, Wales, Northern Ireland on the subject of joining this new union. No political parties registered in England are to be allowed to participate in any way shape or form in these decisions. No funding either should be permitted from outwith those Celtic fringe nations. Northern Ireland should be permitted a Border Poll with same rules.

This new written Constitution should be the result of civic society and not the work of the present political parties or the vested interests of the City of London. The City and UK media needs to be subject to very strict regulation. Number one, no individual living outwith the UK tax area should be allowed ownership of any Newspapers or Broadcasting outlet. Nor can any of these entities be registered offshore to avoid taxation.No individual or corporation allowed to own more than one newspaper.

Apologies and corrections in newspapers for example need to be printed on the front page not an inside page. Political and News broadcasts must be subject to fact checking organisations. Any breaches not corrected accordingly must be subject to legal recourse. At present we have a media and broadcasters in the UK that print and broadcast blatant propaganda and lies. They are also allowed to self-police. That needs changed and a true public selected oversight organisation needs put in place.

Never again should any government be allowed to appoint Director Generals to a state broadcaster. Indeed, they should not be allowed to appoint anyone to any public body. We should use a committee formed from the general public that serve and are chosen as we now choose our juries. They should sit for pre-determined timescales and be reimbursed for said civic duty. These choices must be taken by the public, not those in charge of the government.

The law must be available to all, not just affordable by the few. Legal costs need capped and regulated.

Never again can we have a situation like Brexit where one part of the union overrules other parts of the Union. We are either equal participants or we are colonies! Each of the participants in this new union will have a vote and a veto on any Union matters.Not as now where only one nation has a vote and a veto.

All parts of the Union will have full autonomy of their own resources, taxes and expenditure. A forum shall be formed from all parts of the Union to decide Union expenditure. From now on the Union will receive a block grant and will have to remain in budget. The Union will have no borrowing powers those will rest with the nations parliaments. The power will be retained in the different nations of the Union.

All nations will be allowed to make their own international trade and alliance agreements. If England doesn’t wish to be part of EFTA, EU then that is their decision likewise if Scotland wishes to be in either so be it and the Tweed becomes the EFTA/EU border.

The new Union is only there to meet the demands that are favourable to all the participants. Not as now where everything is done to suit the South East of England and the City of London. The new Union Parliament should be a rotating body operating in 6 monthly cycles in the participating nations. This new Union will end England’s ability to fund their nation from the resources of their neighbours. It is time for England to take responsibility for itself and stop behaving like an imperial bully. Truly take back control and stop hiding behind the Celtic nations.

The Celtic nations will be fully autonomous entities and participate in a British Union much as UK participated in the European Union. Each nation will have a vote and a veto. That way we share sovereignty and we are all equal. Only imperialists can object to that!

  • I do not think that any new Union would work will England and its institutions remain corrupt. As indeed do so many of our own due to various vested, malicious and other interests.

    We need complete separation first and foremost. We need to establish our own public bodies, institutions, constitution, priorities, trading partners etc.

    We don’t need a new/old British Union or ‘Union of the Isles’. We just need a decent relationship with England as we would with all other states. That will come when England, and its government, behaves itself.

    Or else it won’t.

    • Exactly, it is absurd to suggest that there should be a new union when the one that was ratified in 1707 (a trade Agreement) has been so robustly disregarded by both countries governments. So much so that the Scots don’t even know what the terms of the treaty actually are and even more importantly what is specifically omitted! There is nothing to suggest that anything different would happen should a new treaty be created and ratified.

    I’m guessing your promoting this to attract the “soft no’s” and other house jocks because it’s far better than what we have now but in my opinion any union with England will end up the same way this one has

    • Then I apologise I thought what I had written would be understood better. What I am suggesting is the destruction of this Union. In its place something akin to The Nordic Council or EFTA autonomous states, cooperating, sharing sovereignty, not one nation dominating. Whatever happens we need some kind of arrangement with our nearest neighbour.

      • There’s no other way in which “reform” can be “understood better”, Roddy: you can’t reform that which had its genesis in structural irreformability. The City of London!??? Scotland will only flourish by its 100% independence from the stinking Union and all of its corrupted institutions. Only when that is achieved will it be possible to speak of pragmatic cooperation with anybody. Keep it fundamentalist, brother.

  • The old USSR had two major newspapers PRAVDA (The Truth) and IZVESTIA (The NEWS). All newspapers were heavily regulated to print what the Government thought acceptable. They were not regulated regarding truth or decency. Investigative journalism resulted in jail terms for the journalists. Exactly like Scotland.

    The old saying that there is no pravda in IZVESTIA and no izvestia in PRAVDA. Could easily apply to Scotland.

    Independence is coming and the quisling churnalists in Scotland would do well to look at the fate of their USSR counterparts.

    England’s institutions are corrupt, as are Scotland’s. We can begin to fix Scotland’s after independence. We will never be able to prevent the corruption of our imperial masters.

  • The UK cannot have a written Constitution because the popular sovereignty of Scotland’s people and the sovereignty of an English monarch have fundamental incompatibilities, and irreconcilable differences which a written UK Constitution would have to resolve, but cannot do it. The sovereignty that is reserved for a single English monarch is the same Constitutional sovereignty bestowed on every living Scot as their birthright.

    The concept of UK Parliamentary Sovereignty is based upon layers of unwritten convention, a myriad of sophistry which works around Scotland’s Sovereignty essentially by saying Scotland is in a voluntary Union, and volunteers consent to go along with whatever the UK Parliament decides. Thus, Scotland’s agreement is simply presumed given by default, with no need to ask for consent. It is a consensual Union, with Sovereignty effectively “on loan”. Scotland is still sovereign, but is permanently resigned to go along with whatever Westminster decides.

    That is why Brexit was such a hollowing failure for Sturgeon’s SNP, because unlike the unwritten convention of Parliamentary Sovereignty, Brexit was a referendum which asked the sovereign people of Scotland a direct question. Unlike the neat and tidy Convention of UK Parliamentary Sovereignty, Scotland’s tacit consent could not be presumed, because Scotland was given a choice and actually, Scotland’s consent was not given. The Sovereign people said no… emphatically.

    Brexit, particularly Scotland’s forced Brexit against the will of the sovereign majority, thus demolishes the fallacy that Scotland is in a “consensual” Union. Scotland said no. Consent denied. Brexit was thus an act of unlawful, colonial subjugation.

    Thus, the Union Treaty is itself demolished by any number of literal breaches of the Articles of the Treaty, (as the SSRG open letter confirms, you can pick and choose from multiple breaches of the Treaty), but what has also been demolished is that unwritten convention which underpins the whole concept of UK Parliamentary Sovereignty.

    “IF” it was plausible to argue Scotland was in a consensual Union before Brexit, it is certainly not possible to maintain that fallacy after Brexit.

    The Treaty of Union is breached, and the UK Government’s unwritten convention on UK Parliamentary Sovereignty has been shredded.

      No-one can dispute, with a straight face, any of the points you make in this article Roddy. However, since our main focus is the removal of Scotland’s colonial status and her re-instituting her autonomous position in the wider world, all of it is academic.

      Once Scotland has secured its Independence from the current so-called union, the English would be well advised to re-visit your article and begin to take the actions which you suggest.

    • Agree, the only bit I differ with is the EU exit. England could end that treaty without consent from Scotland as Scotland was not a signatory to the EU. Therein lies the problem.Scotland has permitted the English government to ratify each and every international agreement, treaty, declaration etc under the name of UK – a name the English government and its establishment have openly stated means Greater England NOT Great Britain which is the official name of the state. Scots should never use the term UK unless they too view the state as a Greater England and thus accept the English Government as sole authority.

      100% Scotland needs to dissolve the treaty today not some time in the future, if at all. All terms have been fundamentally breached and the English government even stated that they do not recognise the treaty as being in effect. Why Scots are continuing to put up with this absurdity is beyond me. Legally there is absolutely nothing stopping Scotland from walking right this moment.

        The correct conclusion to Brexit should have seen Scotland’s rejection of Brexit serving as a Constitutional veto, keeping the whole UK in the EU. The best comparison for that is an EU Member having the right to veto EU Legislation. The EU cannot subjugate the sovereignty of its Nation States. Neither can the two sovereign equals in the Treaty of Union.

        There is a complication however, that Scotland’s sovereign veto blocking Brexit would have meant Scotland’s will overruling England’s, and you’re into the same unconstitutional territory once again, just approaching it from the opposite direction. However, wherever there’s a constitutional stalemate, I believe convention would ensure the status quo would be maintained, and the UK should have stayed in the EU.

        The bottom line with Brexit is that the two sovereign entities which form the United Kingdom voted for opposite conclusions on a binary option, and thus, to prevent one “equal partner’s” subordination of the other “equal partner”, (and thus being an act of unlawful subjugation), the rightful conclusion to Brexit should either be the Union torn apart with each sovereign entity pursuing it’s own mandate, or, there would have been Constitutional Deadlock. However unraveling that Constitutional Deadlock would also have unravelled the sophistry and faux conventions shoring up the Treaty of Union itself.

        The UK Treaty of Union, and Scotland’s subjugation, would not have survived International scrutiny… In my opinion anyway.

        • As usual it should come as no surprise that I agree with you Breeks , okay Gayle as you say the uk signed up to brexshit which obviously means both england and Scotland as equal partners , england voted for brexshit Scotland didn’t but by dint of overwhelming numbers england FORCED the other EQUAL partner in the uk union to accede to england’s demand .

  • People in Scotland have no business in even suggesting changes in how England is governed. That’s for those in England to determine. The SNP made the mistake of trying to interfere with how England voted with brexit. An independent Scotland would deal with England and every other country in the world, as it was, not as how it would like each of them to be. The problem isn’t how England chooses to govern itself, it’s how it governs Scotland within the UK. Independence is the only thing that can change that. It’s change in Scotland that should be the focus, not any other country.

    • This article does not tell England how it should govern itself not in the least. It proposes how a new Union of the nations should operate as autonomous nations in a cooperation agreement. Much like Nordic Council or EFTA. If England or any other of the Home nations does not wish to participate, sobeit. This article shows a way, IMHO the only way to reform the union.

        That isn’t telling England how it should be governed? Hoping for change in a country whose whole being is based on living in the past is simply a waste of time.

        For me the main subjects at the moment are the SSRG plan and the development of plans within Alba.

  • Very well said Roddy, however, we are surely kidding ourselves on that Westminster can change or even wants to change, there’s far to much cash on offer once you get your foot in the door. Not having a written constitution allows them to chop and change and do as they please when it suits them.

    I wonder if the SNP/Holyrood will ever get around to penning a written constitution for Scotland, or will they continue to go down the same road as Westminster, leaving it open to what their interpretation is on any given circumstance.

    I personally think we shouldn’t bother our backsides with Westminster it will never change, and concentrate on Holyrood, by trying to hold our own parliaments corruption to account whilst pushing for independence.

    I am told to “wheesht for Indy” and remove Westminster while the blatant disregard for my views and more importantly Women’s views are ignored. I am to be outraged by Westminster while the SG manipulates the Legal system to imprison Craig Murray and attempt the same with Mark Hirst and Alec Salmond. The Tories are to be vilified as looking after their buddies while Sturgeon puts unelected bodies such as Stonewall into key positions of influence. Does she think I am blind to her political constructs in Scotland that she funds and uses to attack her enemies.

    I have campaigned for Independence all my life. I detested a Westminster who dictated the shape of Scottish society. I do not want to gain Independence to have the People ignored by a home grown Tyrant pretending to care about the Rights of the Scottish People.

    I will not be conned into putting a Tyrant in charge of a Nations future who is using my desire for Independence as blackmail.

    To those who try to tell me that it will all come right after Independence – look at how the internal democracy of the SNP was destroyed. Lunchtime rule changes. Rigged NEC membership by affiliation. Etc etc. This is a clique ruthless in holding Power.

  • I thought that this was a rhetorical proposal for a new Union to demonstrate why we should never agree to be a part of it, not that England would ever want to be part of such a union anyway. We do need a relationship with our closest neighbours and largest trading partner after independence, Scotland should be an EFTA member, EFTA and the UK have a free trade agreement which Scotland could sign up to as soon as we become EFTA members, so Scotland and England have a free trade agreement via EFTA, no hard border, free movement of goods and services, and free movement of people. I’d be happy with that sort of relationship, who wouldn’t ?

  • GB does not have a written constitution because what was ratified in 1707 was NOT a political union but an international TRADE Agreement between 2 sovereign nation states.BOTH countries retained ALL of their rights prior to and after the signing. This is further stipulated within the terms. The treaty did not and does not have the authority to abolish any other treaty, declaration, covenant etc. Neither does it have the authority to revoke the Scottish constitution, Scotland’s independence nor Scots sovereignty. These are enshrined in perpetuity and in the case of Scotland’s independence and sovereignty is part of its ancient laws and customs which are held in perpetuity.

    There is no state:

    Government of GB despite there being a parliament.
    Constitution
    Territorial Border
    Religion
    Capital
    Military
    Institutions bar a shared treasury with equal representation
    Parliamentary sovereignty nor clause granting the transference of English parliamentary sovereignty onto the parliament of GB
    Majority Rule nor clause granting dominion based on MP, population, voting numbers
    Party Political System
    Legal System

    Nor is there anything that says English parliamentary customs must be used within the parliament of GB.
    And as folk know, or at least should know, a custom is not law it is a convention. While it may be observed, it has no legal standing. That is why the English government is actively making laws to turn customs into law! Folk need to learn the difference and stop treating the English government as the sole authority of GB. They are NOT. They are an equal partner, nothing more. The observation of English parliamentary customs must end. And Scotland should not be accepting any “new” union with England.

  • I think you’ll find that once Ireland becomes reunited, and that can’t happen soon enough, there will be, given that they are not actually British, zero appetite from the Irish people to join any form of ‘British’ union.

    • Northern Ireland will never Vote to be reunited when iigains so much from being part of the UK, Northern Ireland has a fully devolved NHS on par with the UK NHS but Eire instead has a Health Service where two thirds of the population have to buy extra Health Insurance in the same way as in the USA model works. Even the one third who get free health services in Eire don’t get what people get in the UK ie cosmetic surgery etc the Eire heatlh service only covers the very basics compared to what the UK NHS does.

      • NI was set up on a purely sectarian headcount and was run as an Apartheid state with massive discrimination and violence against the indigenous population. That’s a simple fact. Health is, according to the latest opinion polls, the number one topic of conversation regarding the reunification of the country. Fortunately the largest party across Ireland, Sinn Fein, who are also doing the greatest campaigning for a UI are also now actively pushing for an all Ireland health service that is free at the point of delivery. That’s not being argued for so it can sway voters to support a UI, it is being done as a matter of decency. If it does sway voters then that’s a bonus.

  • Any governmental association with England would be doomed to failure, even autonomous Nations. It’s in the nature of the mindset of the heirarchy down south. Colonialism, what you can’t keep, you try to damage when they leave. Westminster is doing extreme damage to Scottish industries now, so the sooner we leave by whatever means the better. Complete independence and a hard border is the only answer.

    I am not surprised, and i am inclined very much the same way,

    Over the last 300 years trust in the union has totally disappeared, it has to be said, it has been bias in favour of Westminster, London and the crown,

    Scotland’s laws are being consumed along with every other globalist “build back better” mantra.

    I do not think the people of Scotland wish to sink any further with the British Union version of their titanic ship for Scotland.

    And although it is suggested we remain separate in you’re blog,
    The Scottish people no longer trust the British government not to twist the rules such as conventions and treaties.
    The written word means nothing to to them, nor promises and conventions that are pie in the sky under their manipulation.

    I do not think there is a country left that holds them in high esteem.

  • A new ‘union’ as our own individual countries, in whatever form that may take. It’s an interesting question which is stimulating good debate here. The eyes of the world will be watching how Scotland goes about reclaiming our sovereign right. In doing so, this would put Westminster on the back foot (again) for all to see in all their glory.

    With a genuine First Minister proactively leading the way, this may present pre-iScotland with an ideal opportunity to lay out our divorce terms and prepare for independence NOW. Preparation is the key.

    In dissolving this current entity that we know as the United Kingdom, all of the shared assets between Scotland and England are to be divvied-up accordingly. Scotland should put Westminster on notice and itemise ALL of the UK’s shared assets that are to be negotiated and distributed equally between our individual countries.

    So let’s itemise all assets and put it to Westminster NOW. Make their parliament acknowledge that these are Scotland’s terms. If they are going to contest our rightful demands, now would be the time to get it all out in the open air for all to see. Make them respond, make them answer. The UK exit from the European Union took (and is still taking) long enough, so let’s make a start on it NOW. We need to think, plan and operate as an already future independent Scotland once again.
